Underwater fetish lands man in jail again

An Auburn man’s alleged bizarre aquatic sexual fetish has landed him in legal hot water yet again.

Former attorney Jonathan R. Tyrell was busted for parole violation last week, after he tried to recruit an Auburn teen for a bogus research study on “underwater sleep apnea,” Roseville Police said.

“In reality what this study was accomplishing was satisfying his sexual urges to see people underwater holding their breath,” said Det. Sgt. Darin DeFreece.

That’s the activity that resulted in a conviction for misdemeanor child molestation following a 2005 RPD investigation, authorities say.

In that case, Tyrell identified himself as a scientific researcher to teenagers and young adults, then paid them to be research subjects, according to previous reports.

Tyrell immersed them in his bathtub and asked them to hold their breath while he photographed and recorded them.

“The court has ruled that that violates the penal code and is considered harmful matter,” DeFreece said.

Tyrell, who pleaded no contest, served three years of a five year and four month sentence for the molestation charge as well as for forgery, possession of methamphetamine, and battery causing serious bodily injury.

DeFreece said Tyrell recently approached the Auburn teen where he worked as a server in an Auburn restaurant and offered him a job as a legal assistant – neglecting to say he was disbarred in 2007.

Tyrell allegedly told the teen he was applying for research grants on underwater apnea and asked him to help draw up a “legal contract” for test subjects.

“He’s doing the same thing that he did before,” DeFreece said, adding that terms of Tyrell’s parole restricted him from doing so.

But the young man’s father grew suspicious when his son told him about the proposition. When an Internet search turned up news stories about Tyrell’s earlier case, the father called Roseville Police.

Tyrell’s former employer, Gloria Martinez-Senftner of the Martinez-Senftner law firm in Roseville, didn’t return a call for comment.

In court records filed last year, Tyrell claimed he should be released partly because of “outrageous misconduct” on the part of Roseville Police. He claimed they subjected him to “intracranial sounds” including “barely audible…buzzing, tones and voices” in his bedroom and bathroom. A judge had yet to rule on the claim.

“At least one of these broadcasts included the rap, entitled: ‘You’re Busted! We’re Going to Get You!’” Tyrell claimed.

DeFreece said he thinks it’s likely Tyrell may have contacted other people, including minors, in his recruitment efforts. He’s asking anyone with information to call Police Investigations at 774-5070.

“I sincerely believe there are people out there he reached out to that maybe didn’t bite,” DeFreece said.

Tyrell was currently in custody in the California Department of Corrections awaiting a parole violation hearing.

Mr. Green. Your comment on this article about teens being violated is repulsive. And you were involved and promoted Peer Court?

The behavior is bizarre. But is it criminal? If he doesn't touch or fondle, or take photographs of disrobed minors, how is this molestation? Still, I don't like the idea of him luring kids into his home on false pretenses, and I agree with the notion that he should not be allowed to associate with children. I'm just not sure I want to spend my tax dollars maintaining this guy in jail more than a week or two.

The young man's father should be applauded for caring enough to follow his intuition and research this predator!!! Parents don't be afraid to ask..snoop...prod...whatever it takes to know where your children are and who might be influencing them!!!

Forget about the molestation, what about the fact that he makes kids get into his bathtub and hold their breath underwater! The next logical step is for him to hold them under water just a little linger to take more photos...This guy is insane. And now he is is hearing voices or sounds courtesy of the Roseville P.D.! He's exhibiting classic symptoms of a psychosis. Doesn't the court require psychological evaluations anymore?

Why not focus on the bizzare behavior of the man in this story instead of an off-handed comment by Jongreen.

Some of you have no sense of satire.

I think all child molesters including Tyrell should be put to death as they never stop and are always a threat. And don't give me that mentally ill bs.

Peer Court discovered many of the defendants were being abused and reported the abuse to law enforcement and the district attorney. Of course now that Peer Court is not operational those first time offenders abuse is probably not being reported. The coordinator of Peer Court is a state licensed counselor and a mandatory reporter of abuse.

That guy is a creep and there is no telling what he will do next! Gulliver, you dont see an issue with a man wanting to take pictures of kids in a bath tub?? Then you should volunteer to go partake in his "study".

I have an opportunity to read your piece on my November 17, 2009 arrest. I believe that it places me in a false light. I think that a bit of parity is important; would you like to read the Deputy Commissioner's factual findings regarding my "alleged bizarre aquatic sexual fetish"? I think it important to see both sides of this story, because when these allegations see the light of day, in a fair and impartial arena, they fail. Your story allowed Det. Sgt. Darin DeFreece to control the tempo, much to the detriment of the truth.

The Deputy Commissioner (Board of Parole Hearings) found no probable cause to believe that I engaged in misrepresentation or forgery -- the charges which resulted in my arrest and detention. More importantly, the Deputy Commissioner found that I gave credible evidence regarding the legitimacy of the apnea research. Assuming the legitimacy of the apnea research, I have committed no crime, and I committed no such crime in 2005. I remind you that I have a 1st Amendment Right to publish my findings, and that simple fact has been ignored these many years.

r. Donato-Weinstein, I am not an individual bizarrely obsessed with nonsexual underwater images. However, I am obsessed with vindicating my 1st Amendment Rights, and to bringing a measure to reassurance and comfort to those hurt in 2005.

am angry Mr. Donato-Weinstein -- angered by law enforcement officers who ignore and hide evidence, and then call reporters.
