City cannot regulate dogs

Regarding the Oct. 26 article, “Councilman proposes pitbull ordinance,” the city of Auburn and its council members better read California state law before they start trying to pass regulations that are not even legal for them to pass. There is no point in even having a discussion about banning pitbulls or listing them as dangerous or having fence heights exclusively for them or limiting households to owning only one pitbull, etc. since it is not legal for a local jurisdiction to do any of the aforementioned in the state of California. The only breed-specific laws local jurisdictions can pass are with regard to breeding restrictions and sterilization (spay-neuter) regulations. Patty Letawsky, Wilton

Patty, I think you are right.
Instead, we should put the guy in jail for reckless endangerment, and hopefully a judge provides $25,000 or more in restitution to the victim.
We have laws, no need for more.

It's the owners and not the dogs who are legally, morally and financially responsible for their dog's behavior. Can't sue a dog for hospital bills.
