DA declines to prosecute official’s case
Charges dropped against water board member
The District Attorney’s Office has declined to prosecute a domestic violence case against an Auburn public official. On Monday, Karin Bjork, supervising district attorney, said after looking at all the evidence available, including any possible defenses that a jury might consider, the office did not believe it could prove the case beyond a reasonable doubt. In July, Lowell Martin Jarvis, a Placer County Water Agency board member, was arrested on a charge of willful infliction of corporal injury to a spouse, former spouse or cohabitant. Jarvis was elected to the board in November 1996 and represents District 3, which includes Auburn, Loomis, part of Rocklin, Penryn, Newcastle and Ophir. The water agency services Placer County’s approximately 350,000 residents and covers the entire geographical area of the county. For 2009, the agency reported a $82,441,348 budget. ~ Jenifer Gee

Lack of evidence seems to prevail when public officials are involved. Either the police does a bad job or the DA just uses the excuse.
I'm beginning to distrust Placer County more and more every day.
Let's see if there is a word printed in the A-J over the Sheriff's Lt. incident in Rocklin almost two weeks ago. The results of the investigation have been turned over to the DA. Will they find sufficient evidence?
Loomis, maybe there just wasn't enough evidence. Many times these things end up as a he said/ she said. That's hard to take to a jury I imagine.
Realist, maybe you're right, maybe auburnnative is right. I guess we will never know, will we? One thing is for sure, the evidence is proportional to the effort put forth to gather it, no effort or half hearted effort= poor or lack of evidence; throw adequate resources at it and the evidence will be sufficient. Many ways to go and many possibilities.
And still no word in Placer County about the other incident. Hmmm.
Maybe the County Board of Supervisors will file civil litigation against Jarvis, like they did against another private citizen Ollar-Burris. Wait, didn't the county's case collapse there? Maybe they will stop prosecuting taxpayers who don't agree. Wait and see.
Too much 'Conspiracy Theory" here. In my limited experience the Placer County D.A.'s office does a good job of prosecution. I don't think that the fact the accused works for PCWA made a difference. Domestic dispute cases are usually what Realist called them- He said/ she said. I'm surprised at Loomisresident, quite a bit of criticism towards our law enforcement officers. However; I do think there should be more info on the Rocklin incident.

CCR102, although I have never had an incident involving wrongdoing on my part I have had two cases of property crimes that didn't even arouse the Sheriff' Department's curiosity much less launch an investigation. One was property damage to our house at the tune of $15,000.00 in the mid 1990s and the other involved the shooting death of a show horse. Neither one of these incidents even started an investigation, we simply were given Report numbers to be turned in to our insurance company. In the first case, a neighbor got a license plate and I took it from there, I was never able to feel a pulse from PCSO, total lack of interest.
On a more recent incident a friend lost a horse due to illegal trail riding by off road motor bikes in the Folsom SRA, the Park Rangers did a great job investigating the incident, had names, witnesses, etc, I saw the report myself, however the DA decided against prosecution. So there, that's why I am critical of the Department, not the Deputies, they do the best they can. The County and it's Management are the ones I have a bone to pick with not the rank and file employees who have to abide by the rules and regulations. I'm sure that rebelling or bending those rules will bring swifter, harsher action than the highly dangerous actions of this Lieutenant. It's all who you are and who you know and your membership status in "the good old boys club".
Placer County D.A. prosecutes a lot of CRAP CASES!
If that was your everyday "John Doe" citizen, they would have found plenty of evidence against him.
If the man was arrested there would at least have to be bruises on the spouse. The cops can't arrest otherwise but they can "Detain" especially if one of the persons must leave the home.
Steelybob is the only one who's even close on this one.
If the facts were known, the public would learn that the charges were bogus. If anything, Mr. Jarvis should file false and frivolous charges against the real perpetrator, or better yet, file assault charges where warranted, and file to recoop his own legal costs to defend himself (which probably wasn't cheap). He's too nice a guy and probably will do nothing.
Meanwhile some pompous commenters sit on their high thrones, passing judgment on something they know nothing about. It must make them feel better to take pot shots at any government operation/official at ANY chance they get to try to diminish government in the eyes of the public.
Because all budgets are cut, the DA can't investigate or prosecute even the worst of cases. Each case takes literally months of research to press charges and then build a case good enough to prosecute and have a chance of prevailing. If they don't have the goods, why waste any taxpayer dollars. If there is mismanagement, then take those charges all the way.
We don't at all agree with most of the county's decisions, but in this case, there is no good ol' boy shenanigans, no cover up, and no wrong doing on the part of the DA. The case against Mr. Jarvis was trumped up in an atmosphere of viciousness and vindictiveness.
Somebody owes him a huge public apology (and a reimbursement), but I bet he'll never see it.

Randall, no one has to take potshots at Placer County Government to diminish them in the eyes of anyone, they do a great job themselves, if they do a job at all. I can prove every word that I said in regards with the total lack of interest PCSO had on the two property crimes and I can show you the evidence that the DA chose not to prosecute. Perhaps you should direct your chastisement at those that have created the atmosphere of distrust towards County Government, Try Uhler, Rockholm, Weigandt and Miller for starters.
Like lusitania said, the DA prosecutes a lot of crap cases, those that are either politically advantageous or very easy to win convictions.
Give us your opinion, are we ever going to hear about the little incident in Rocklin? You seem to be very knowledgeable on the workings of the County so your opinion is revered by the pompous commenters.
loomis - I have absolutely no knowledge about the case in Rocklin that you reference. There may be serious problems with integrity among county officials, but I seriously doubt that this case qualifies as a good ol' boy deal. I have had occasion to discuss this case with people who know Lowell and his situation. To put it dellicately, he is probably more of a victim than a suspect.
He's a victim? I'm telling you right now that there must be visible signs like bruising before PCSO arrests someone. Lowell received no special treatment.
It's the way it is. The crime wasn't worth prosecuting. That's all.
If I attacked my husband and he pushed me away in self defense, he could easily bruise me. I bruise easily and am a clutz to boot. Bruises might indicate something, but prove nothing, especially if a person is mentally unstable.
"Selective Prosecution" has nothing to do with merits of a case!
