City clerk receives three eviction notices, waiting for court decision

City Clerk Joseph LaBrie confirmed Thursday that three eviction notices have been posted on his Auburn apartment.

However, LaBrie, who was elected in 2000, refused to comment further saying he would wait until a judge’s decision is announced.

A four-day hearing regarding the matter concluded this week in an Auburn courtroom, LaBrie said outside of his apartment off Auburn Ravine Road Thursday afternoon.

The eviction notices also involve Palm Apartment owner John Mays. Mays declined to comment when contacted by the Journal Wednesday.

LaBrie said he’s been elected three times and served as the city’s clerk for almost nine years. As city clerk, it is his duty to swear people in, manage meeting minutes and attend City Council meetings. The part-time position receives a $300 a month stipend plus health benefits, LaBrie said.

Why would the Auburn Journal publish such an article. Its not like Mr. LaBrie has access to City funds. I feel this is a personal matter and not necessarily for public consumption.

Is this newsworthy? Maybe, maybe not, but the story itself has almost no factual content. There is no such thing as a self-executing "eviction notice." There may have been a 3-day notice to pay rent or quit followed by a Summons & Complaint in unlawful detainer, but the Journal doesn't say which was involved here, although we can infer from the fact that the tenant is waiting for a "judge's decision" to be announced, that an actual Unlawful Detainer case was filed with the court and that a trial has already occurred.

We don't even know the basis of the pending eviction. Most evictions are for non-payment of rent, but an eviction can be based on other violations of the rental agreement, such as unauthorized pets, or disturbing the peace of other tenants. In fairness to the Journal reporter, with neither the tenant or the landlord willing to comment, and with the court's policy of not allowing 3rd parties to review the court files in pending eviction cases, maybe this was the best she could have done.

I am sorry I even opened this article. Big waste of time. Is this the best the journal has to offer?

You have got to be freaking kidding me!? Like really who cares? Do the people of Auburn or the surrounding areas need to know this information? I mean who wakes up and says "I wonder what is going on in the city employees lives?" Whats next, City Officials and the Blockbuster late charge outrage? Seriously, waste of time, lets see if any of these comments make it on the paper as the quotes from online...

I can't possibly imagine a more fulfilling journalistic career than parking in front of city clerk's homes and waiting for notices to be posted so I could report on them.

A four day hearing for an eviction notice? More here than meets the eye. That's a lot of court expense, judge, clerk, recorder, bailiff.

If this person were not the City Clerk would it have made the news? I agree with SteelyBob on this one.

Maybe we are being prepared for a much bigger story. After all, it's not like anyone would be surprised to hear that Auburn is run by unethical folks!
